when imitation products began appear, fürst initiated court process attempt secure trademark. @ first, dispute concerned confectionery producers in salzburg, later spread include competition germany. result agreement obliged fürst’s competitors use other names. mirabell firm, based in grödig near salzburg, chose name, “real salzburg mozartkugeln”. bavarian producer, reber, opted “real reber mozartkugeln”. in 1996, dispute between fürst , subsidiary of swiss food producer, nestlé, wanted market “original austria mozartkugeln”, decided in third instance. fürst s products may called original salzburg mozartkugeln .

at end of 1970s, dispute arose between industrial confection producer mirabell (today part of mondelez international) , competitor reber on mozartkugel trademark. provisional agreement reached in 1981 between representatives of austrian , german governments, whereby austrian producers allowed use label mozartkugeln . reber protested against agreement, , ec-commissioner in brussels charged deciding in affair declared agreement invalid. why reber may legitimately , continuously use genuine reber mozart-kugeln trademark, though hyphen in-between.


nonetheless, mirabell mozartkugeln allowed round. other industrially produced mozartkugeln must have 1 flat side. beside mirabell , reber, mozartkugeln manufacturers include hofbauer, vienna (part of lindt & sprüngli) , manner, halloren in germany.
