the cleveland police department received statements both loehmann , garmback. announced looking additional witnesses shooting, including man recorded walking rice in park before shooting. results presented grand jury possible charges.


on january 1, 2015, associated press reported cleveland police department officials looking outside agency investigate rice shooting, handle future investigations related deadly use-of-force incidents.


on may 15, mother jones magazine reported that, 6 months after shooting, while sheriff s department announced had concluded investigation of shooting, neither of 2 officers involved had yet been interviewed investigators cuyahoga county sheriff s office. reported of time frank garmback, officer drove police car, not under criminal investigation.


on june 3, cuyahoga county sheriff s office released statement in declared investigation completed , turned findings on prosecutor tim mcginty, expected review report , decide whether present evidence grand jury. in response petition citizens, on june 11 municipal court judge ronald adrine agreed officer timothy loehmann should charged several crimes, serious of them being murder including involuntary manslaughter, reckless homicide, negligent homicide , dereliction of duty. judge adrine found probable cause charge officer frank garmback negligent homicide , dereliction of duty. because ohio judges lack legal authority issue arrest warrants in such cases, opinion forwarded city prosecutors , cuyahoga county prosecutor timothy mcginty who, of date, had not yet come decision on whether present evidence grand jury.

on june 13, cuyahoga county prosecutor tim mcginty released redacted 224-page report of investigation. report included interviews @ least 27 people, including teachers, friends, , person called 911. loehmann , garmback declined interviewed. contradicting statements made police loehmann shouted show hands 3 times before firing, report included accounts several witnesses did not hear officers issue verbal warning rice.

on october 10, cuyahoga county prosecutor s office released 2 reports mcginty had sought outside experts use of force, 1 retired fbi agent kimberly crawford, second colorado prosecutor s. lamar sims; both reports concluded shooting of tamir rice reasonable under circumstances. however, amid accusations lawyers representing rice family mcginty had deliberately chosen crawford , sims because of pro-police bias in order cover loehmann , garmback, mcginty convened grand jury consider whether or not criminal charges should brought against officers.


on december 28, mcginty reported grand jury had decided not indict loehmann or garmback, saying, given perfect storm of human error, mistakes, , communications involved day, evidence did not indicate criminal conduct police. announcement prompted rice s mother release statement accusing mcginty of mishandling investigation, stating in part, prosecutor mcginty deliberately sabotaged case, never advocating son, , acting instead police officers defense attorney.


three expert witnesses testified before grand jury criticized prosecutors behavior during grand jury. roger clark, retired lasd officer expertise in police shootings, said prosecutors @ hearing treated him hostility , disdain concluding loehmann , garmback had acted recklessly; described prosecutors using theatrics, none d ever seen in previous grand jury proceedings, believed intended lead grand jurors conclusion prosecutors wanted them reach. jeffrey noble, retired police officer , expert in use-of-force cases (who had himself used deadly force on job), said attacked prosecutors saying officers never should have escalated situation rushing rice, adding, i’ve never seen 2 prosecutors play defense attorney well. , jesse wobrock, biomechanics expert hired rice family s lawyers, described prosecutors acting in way defense attorneys cops, , having attacked him professionally testimony regarding timing , significance of body movements loehmann , rice, seen on video footage of shooting. (a spokesman mcginty s office said 3 experts presenting 1 side of story, not elaborate because prosecutors bound grand jury secrecy laws.)


wrongful-death suit , settlement

on december 5, 2014, rice s family filed wrongful-death suit against loehmann, garmback, , city of cleveland in united states district court northern district of ohio. eight-page complaint accused loehmann , garmback of acting unreasonably, negligently [and] recklessly , [h]ad defendant officers approached tamir , investigated possession of replica gun undoubtedly have determined ... gun fake , subject juvenile. accused city of cleveland failing train both officers, failing learn independence police department s internal memo loehmann.


on april 25, 2016, lawsuit settled in effort reduce taxpayer liabilities, city of cleveland agreeing pay tamir rice s family $6 million ($5.5 million tamir rice s estate, $250,000 boy s mother, , $250,000 boy s sister).


protests

in wake of shooting, protests , public outcry broke out in cleveland, although relatively minor. however, on november 25, 2014, day after grand jury decision not indict police officer fatally shot michael brown, cleveland protests became more prominent. day, 200 protesters marched public square cleveland memorial shoreway, causing latter shut down temporarily. rice s family pleaded protesters remain peaceful in activities, saying, again, ask community remain calm. please protest peacefully , responsibly.


on december 5, ohio governor john kasich established task force address community-police relations in response rice s shooting , other similar incidents.


rice s death has been cited 1 of several police killings sparked nationwide black lives matter movement.

a funeral service rice held @ mount sinai baptist church on december 3, 2014, 250 people in attendance. remembered budding talents , described popular child liked draw, play basketball , perform in school s drum line. family members criticized loehmann acting in rice s shooting.
