new york s 23rd congressional district had historically been 1 of republican districts in united states. district s seat had been in republican hands since 1873. far northern portion of district—including largest city, watertown—had not been represented democrat since 1850s. in parts of district, last non-republican represent district had been whig. mchugh first elected in 1992, , reelected 8 times on 60% of vote, including running unopposed in 2002.

on september 29, 2009, new york governor david paterson issued proclamation setting special election fill vacancy november 3, 2009, coincide 2009 general election. new york law not provide primary election in cases of special election vacant house seat. instead, each party s nominee chosen party s county leaders within district.
